Announcement No.62, 2008 of the Ministry of Commerce of the People’s Republic of China, on Terminating Anti-dumping Measures on Imported Cold Rolled Steel Products

On September 23, 2003, the Ministry of Commerce of the People’s Republic of China issued Announcement No.50, 2003, deciding to impose anti-dumping duties on cold rolled steel products imported from Russia, South Korea, Ukraine, Kazakhstan and Taiwan, for 5 years beginning September 23, 2003.
Due to special situations in this case and with permission of the Customs Tariff Commission of the State Council, the Ministry of Commerce initially did not implement anti-dumping measures on the products to be investigated. On December 17, 2003, the Ministry of Commerce issued Announcement No.75, 2003, deciding to resume the anti-dumping duties as from January 14, 2004. Subsequently, due to substantial fluctuations in international market as well as significant changes in demand and supply relations in Mainland China, the Ministry of Commerce issued Announcement No.22 on May 17, 2004, deciding to conduct a review on the necessity of continuing to impose anti-dumping duties; upon investigation, the Ministry of Commerce issued Announcement No.53, 2004, deciding to terminate the anti-dumping measures as from September 10, 2004.
In accordance with Article 48 of the Regulations of the People’s Republic of China on Anti- dumping, the time limit of anti-dumping imposition and price commitment shall not be longer than 5 years; But it can be reasonably extended if it is judged upon review investigation that the termination of anti-dumping duty imposition might cause continuance or recurrence of dumping and injuries.
On January 15, 2008, the Ministry of Commerce issued the Announcement No.2, 2008, which reminds that the anti-dumping measures applicable to the case of domestic cold rolled steel product industry would be terminated on September 23, 2008, and that domestic industry, natural or legal person, or other organizations on behalf hereof may submit a written sun-set review application to the Ministry of Commerce 90 days prior to expiration the anti-dumping measures.
Within the defined time limit of this announcement, if the Ministry of Commerce has not received the sunset review application submitted by domestic industry, natural or legal person, or other organizations on behalf hereof, it may decide not to conduct such sunset review.
Therefore, the Ministry of Commerce decides to terminate the anti-dumping measures on cold rolled steel products originated from Russia, South Korea, Ukraine, Kazakhstan, Taiwan as from September 23, 2008.
